Lists of H-2A and H-2B eligible countries published

The US Department of Homeland Security published a notice of the countries eligible to participate in the H-2A and H-2B worker programs, effective January 19, 2021 to January 18, 2022. These programs are only open to nationals of certain countries, which are determined jointly by DHS and the US Department of State.

USCIS has also published the announcement with information about the changes to this year’s list. According to the announcement, the changes include

  • Adding the Philippines to the list of countries eligible to participate in the H-2B program;
  • No longer designating the Independent State of Samoa and Tonga as eligible countries because they no longer meet the regulatory standards for the H-2A and H-2B visa programs; and
  • No longer designating Mongolia as an eligible country for the H-2A visa program because it no longer meets the regulatory standards for that program.

The countries eligible to participate in the H-2A program are:
